1. Acceptance of Terms

These Terms of Use ("Terms") govern your access to and use of the Faxend website (faxend.com), iOS mobile application, and all related services (collectively, the "Service") operated by Obzena LLC, a limited liability company registered in the State of Wyoming, United States.

By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, you must not use the Service.

2. Description of Service

Faxend is a digital fax transmission platform that allows users to send fax documents to recipients worldwide via the internet. Fax delivery is facilitated through Sinch (sinch.com), a third-party telecommunications API provider. Faxend does not operate physical fax infrastructure directly.

3. Eligibility

You must be at least 13 years of age to use the Service. By using Faxend, you represent and warrant that you meet this requirement and have the legal capacity to enter into these Terms.

4. User Accounts

You may be required to create an account to access certain features. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You agree to notify us immediately of any unauthorized use.

5. Acceptable Use

You agree not to use the Service to:

• Send unsolicited or bulk fax transmissions (spam).
• Transmit any content that is unlawful, harmful, threatening, defamatory, obscene, or otherwise objectionable.
• Violate any applicable local, state, national, or international law or regulation, including the Telephone Consumer Protection Act (TCPA) and similar legislation.
• Impersonate any person or entity, or falsely represent your affiliation with any person or entity.
• Interfere with or disrupt the Service or its infrastructure.
• Attempt to gain unauthorized access to any part of the Service.

We reserve the right to suspend or terminate your account if you violate these terms.

6. Document Content

You are solely responsible for the content of documents you transmit through Faxend. Faxend does not store, review, or archive the content of your faxed documents. Documents are processed in real-time for transmission and permanently deleted immediately after delivery.

Obzena LLC assumes no liability for the content of transmitted documents.

7. Pricing and Payments

Faxend offers both per-transmission pricing and subscription plans. Prices are displayed within the Service and are subject to change with reasonable notice. All purchases are processed through Apple In-App Purchase (for iOS) or other authorized payment processors.

Refunds: Due to the nature of the Service (instant digital delivery), completed fax transmissions are non-refundable. If a transmission fails due to a system error on our end, we will either re-attempt delivery or issue a credit to your account.

8. Service Availability

We strive to maintain 99.9% uptime, but the Service is provided on an "as is" and "as available" basis. We do not guarantee uninterrupted or error-free operation. Fax delivery depends on the recipient's fax machine and network availability, which are beyond our control.

9. Third-Party Services

Faxend relies on third-party services, including Sinch for fax delivery. We are not responsible for the performance, availability, or policies of third-party providers. Your use of the Service is also subject to the terms and policies of Apple Inc. when accessing Faxend through the App Store.

10. Intellectual Property

All content, branding, design, and software associated with Faxend are the property of Obzena LLC and are protected by intellectual property laws. You may not copy, modify, distribute, or reverse-engineer any part of the Service without prior written consent.

11. Limitation of Liability

To the maximum extent permitted by law, Obzena LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service, including but not limited to failed transmissions, data loss, or service interruptions.

Our total liability for any claim related to the Service shall not exceed the amount you paid to Faxend in the 12 months preceding the claim.

12. Disclaimer of Warranties

The Service is provided "AS IS" without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Wyoming, United States, without regard to its conflict of law provisions. Any disputes arising from these Terms shall be resolved in the courts of the State of Wyoming.

14. Changes to These Terms

We reserve the right to modify these Terms at any time. Updated Terms will be posted on this page with a revised date. Your continued use of the Service after any changes constitutes acceptance of the new Terms.
